Please read these Terms of Service ("Terms") carefully before using the SongSense mobile application ("App") operated by SongSense ("us", "we", or "our").
1. Acceptance of Terms
By downloading, installing, or using SongSense, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
SongSense is a mobile application that:
- Identifies songs playing in your environment using audio recognition technology
- Displays synchronized lyrics for identified songs
- Provides translations of lyrics in multiple languages
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
4. User Responsibilities
You agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or modify the App
- Not use the App to infringe on any third-party intellectual property rights
- Not use automated systems to access the App in a manner that exceeds reasonable usage
- Not circumvent any usage limits or security measures
5. Intellectual Property
Our Content: The App, including its design, features, and code, is owned by SongSense and protected by intellectual property laws.
Third-Party Content: Song lyrics, translations, and related content are provided by third-party services (Musixmatch, Shazam) and remain the property of their respective owners. We do not claim ownership of any lyrics or musical content.
6. Third-Party Services
The App relies on third-party services including:
- Shazam for song recognition
- Musixmatch for lyrics and translations
- Google Cloud for translation services
Your use of these services is subject to their respective terms of service and privacy policies.
7. Disclaimers
AS IS: The App is provided "as is" without warranties of any kind, express or implied.
Accuracy: We do not guarantee the accuracy of song recognition, lyrics, or translations. Translations may be machine-generated and may contain errors.
Availability: We do not guarantee uninterrupted access to the App or its features.
8. Limitation of Liability
To the maximum extent permitted by law, SongSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.
9. Usage Limits
We may impose reasonable limits on usage to ensure fair access for all users and to manage costs. Excessive or abusive usage may result in temporary or permanent restriction of access.
10. Modifications
We reserve the right to modify or discontinue the App or these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.
11. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
